Terms of Service
The service
Tender Win provides access to public procurement records together with preliminary company-specific screening, readiness observations, saved workflow, reports, alerts, document storage, and draft business materials. Official solicitation documents and the customer's own verified records control every eligibility, pricing, compliance, and submission decision.
Accounts
You must provide accurate account information, protect your credentials, and promptly report suspected unauthorized access. You are responsible for activity under your account and for ensuring anyone using it is authorized to act for the business represented.
Free and Pro plans
The Free plan includes the limits displayed in the application. The Pro plan unlocks the features and usage limits shown at checkout. Feature limits may be used to protect reliability and prevent automated abuse. Public SAM.gov and USAspending.gov links are not sold or represented as Tender Win property.
Subscriptions and cancellation
Pro subscriptions are billed monthly by Stripe at the price shown and accepted during checkout. Subscriptions automatically renew until canceled. You may cancel through the Stripe-hosted billing portal; cancellation normally takes effect at the end of the paid billing period. Except where required by law or expressly stated at checkout, fees already charged are not refundable merely because a customer does not bid or win.
No award or compliance guarantee
Tender Win does not guarantee eligibility, a compliant submission, an award, revenue, savings, or any win rate. Metadata can be incomplete, delayed, amended, or wrong. Customers must open and verify the official record, attachments, amendments, Q&A, set-aside, wage determination, site-visit rules, insurance, security, pricing, and submission instructions before acting.
Draft materials
Capability statements, reports, checklists, bid-review workspaces, buyer questions, and response language are drafts. Missing facts and bracketed placeholders must be resolved by an accountable person before use. Tender Win does not submit bids on a customer's behalf.
Customer content
You retain ownership of information and documents you provide. You grant Tender Win only the limited permission needed to store, process, display, and transmit that content to operate the service for you. You represent that you have the right to provide the content and that it does not violate law, confidentiality duties, or third-party rights.
Acceptable use
Do not use the service to misrepresent qualifications, certifications, ownership, past performance, staffing, pricing, government affiliation, or any material fact. Do not upload unlawful or restricted information, probe or disrupt the service, bypass access limits, share access for resale, scrape the service, or use it to submit spam.
Suspension and availability
We may restrict access when reasonably necessary to address security threats, fraud, nonpayment, unlawful use, or material violations of these terms. We work to keep the service available but do not promise uninterrupted operation or permanent availability of any third-party government source.
Professional advice and independence
Tender Win is not a law firm, accounting firm, insurance advisor, certified procurement office, or government agency. Use qualified professionals when a solicitation or risk requires them. Tender Win is not affiliated with or endorsed by SAM.gov, SBA, GSA, or any government agency.
Changes
We may update the service and these terms. Material changes will be communicated through the service or by email when reasonably practicable. Continued use after an updated effective date constitutes acceptance of the updated terms.
